Itä-Suomen yliopiston Moodle-ympäristöjen (UEF Moodle) käyttöoikeussopimus

User Agreement of the University of Eastern Finland's Moodle environments

1. Oppimisympäristö
•    UEF Moodle on Itä-Suomen yliopiston ylläpitämä Moodle-alustalle rakennettu oppimisympäristö.

5. Käyttäjän huolellisuusvelvoite
Käyttäjä on velvollinen noudattamaan näissä käyttöehdoissa määrättyjä käyttöoikeuden rajoituksia.

6. Vahingonkorvausvastuu
Opiskelija on velvollinen korvaamaan Itä-Suomen yliopistolle näiden käyttöehtojen vastaisesta aineiston käytöstä aiheutuneen välittömän vahingon, jos sopimuksenvastainen käyttö on johtunut opiskelijan tuottamuksesta (tahallisuus tai huolimattomuus).
Opiskelija ei vastaa:
•    välillisistä vahingoista, kuten Itä-Suomen yliopiston saamatta jääneestä tulosta, liiketoiminnan menetyksestä tai muista vastaavista epäsuorista vahingoista;

7. Opiskelijan laatiman aineiston käyttö
Opiskelijan UEF Moodle -oppimisympäristössä valmistama aineisto (essee, seminaarityö, oppimispäiväkirja, ryhmätyömateriaali tms.) voi olla tekijänoikeudellisesti suojeltu teos. Tekijän-oikeus tällaiseen aineistoon kuuluu opiskelijalle. Itä-Suomen yliopisto ei näiden käyttöehtojen nojalla hanki omistusoikeutta eikä minkään laajuista käyttöoikeutta opiskelijan tuottamaan aineistoon.
Opintojakson opettajalla on oikeus asettaa opiskelijan opintosuoritukseen liittyvä aineisto saman opintojakson muiden opiskelijoiden nähtäväksi, jos se on välttämätöntä opintosuorituksen vertaisarvioinnin tai vertaisoppimisen toteuttamiseksi. Tällainen jakaminen tapahtuu vain opintojakson suljetussa UEF Moodle -oppimisympäristössä, eikä aineistoa saateta muutoin yleisön saataviin.
Muilla opiskelijoilla on oikeus tutustua heille näin saatettuun aineistoon vertaisarvioinnin tai -oppimisen toteuttamiseksi. Muilla opiskelijoilla ei ole oikeutta tallentaa, kopioida, levittää tai muutoin hyödyntää toisen opiskelijan opintosuoritukseen liittyvää aineistoa omassa käytössään ilman tekijän nimenomaista suostumusta.
Aineisto on muiden opiskelijoiden nähtävissä vain siihen tarkoitukseen varatun vertaisarviointijakson tai vertaisoppimisvaiheen ajan, ellei opettaja toisin ilmoita. Opintojakson päätyttyä aineisto poistetaan muiden opiskelijoiden näkyvistä.
Muiden opiskelijoiden tulee mainita vertaisarvioinnin tai -oppimisen yhteydessä opiskelijan aineistoa käyttäessään tai siihen viitatessaan opiskelijan nimi hyvän tavan mukaisesti.

8. Tietosuoja

11. Sovellettava laki ja erimielisyyksien ratkaiseminen
Näihin käyttöehtoihin sovelletaan Suomen lakia.
Näihin käyttöehtoihin perustuvat erimielisyydet pyritään ensisijaisesti ratkaisemaan osapuolten välisin neuvotteluin. Jollei erimielisyyttä saada sovittua osapuolten kesken kuudenkymmenen (60) päivän kuluessa neuvottelujen aloittamisesta, sopimusoikeudelliset riidat ratkaistaan Pohjois-Savon käräjäoikeudessa. Opiskelijalla on kuitenkin oikeus saattaa asia myös oman kotipaikkansa tai vakituisen asuinpaikkansa käräjäoikeuden käsiteltäväksi.
Tekijänoikeuslakiin (404/1961) perustuvat riidat käsitellään markkinaoikeudessa lain pakottavien säännösten mukaisesti (tekijänoikeuslaki 61 §).

12. Hyväksyminen
Hyväksyn nämä käyttöehdot kirjautumalla UEF Moodle -järjestelmään sisälle.

Terms of Use for the UEF eLearn Moodle Learning Environment

Please read the following terms carefully before participating in teach-ing (students) or uploading teaching materials (teachers) to eLearn Moodle.

These terms of use become legally binding between the University of Eastern Finland and the user of the UEF Moodle learning environment (teacher or student) upon the user's acceptance of the terms within the UEF Moodle learning environment. The user must read the terms carefully before using the UEF Moodle learning environment.

By logging into the UEF Moodle system for the first time, the user accepts these terms of use in respect of all materials uploaded to the UEF Moodle system and commits to complying with their provisions. If the user does not wish to be bound by these terms of use, the student must immediately contact the responsible teacher of the course in question before logging in, and the teacher must refrain from logging into the system.

1. Learning Environment
•    UEF Moodle is a learning environment built on the Moodle platform and maintained by the University of Eastern Finland.
•    Maintenance windows and service interruptions are announced in the learning environment and through the university's support channels.

2. Support Services
•    The University of Eastern Finland provides pedagogical and digital user support to users of the UEF Moodle learning environment through the university's support channels.
•    A teacher using the UEF Moodle learning environment commits to providing content-related support to the students on their course.

3. Courses and Materials
•    The UEF Moodle learning environment may host both open courses and learning materials and courses and materials restricted to specific user groups (materials).
•    Users may not copy, record, or redistribute materials available in the UEF Moodle learning environment unless permitted by the licence applicable to the materials or otherwise permitted under these terms of use.
•    Only materials for which the uploader holds sufficiently broad usage rights or ownership may be uploaded to the UEF Moodle learning environment.
•    Confidential or classified materials, such as personal data or trade or professional se-crets, may not be uploaded to the UEF Moodle learning environment unless a separately agreed basis and appropriate safeguards are in place.

4. Student's Rights of Use in Relation to Materials

4.1 Scope of Rights of Use
Materials may not be used in any context other than study use related to teaching, without the separate written consent of the rights holder.
Materials may not be transferred to third parties.
Copies made under these terms of use may not be used, distributed, performed, or displayed publicly, or otherwise made available to the public.
The right of use granted under these terms of use is not transferable to another person.

4.2 Copyright in Materials
Materials stored in the UEF Moodle learning environment may constitute a work protected by copyright. Materials created by the teacher are owned either by the teacher or by the university. These terms of use do not transfer ownership of materials to the student.

4.3 Statutory Right of Use for Teaching Purposes
Regardless of the rights of use granted above, students have the right under section 14a of the Copyright Act (404/1961) to use published materials made available in the UEF Moodle learning environment to illustrate teaching, provided that such use takes place within this protected electronic learning environment. This right may not be restricted by agreement.
When using materials or parts thereof, the student must acknowledge the author and other rights holders in accordance with good practice. Rights holder notices incorporated in the materials may not be removed. The student may not modify the materials in a manner that infringes upon the author's literary or artistic integrity or individuality.

5. User's Duty of Care
The user is obliged to comply with the restrictions on rights of use set out in these terms of use.
The user is obliged to keep their personal username and password secure and to ensure that they do not come into the possession of unauthorised parties. The user may not share their credentials with another person. If a separate course key has been issued for a course, the user may not share it with persons outside the course.
The user is responsible for the use of materials and the UEF Moodle learning environment carried out with their personal credentials to the extent that unauthorised use has resulted from the user's own negligence, i.e. failure to comply with their duty of care.
The user is not responsible for unauthorised use that has arisen from:
•    a data breach or security incident affecting the information systems of the University of Eastern Finland to which the user did not contribute; or
•    any other cause contrary to the user's will and careful conduct.
A user acting with gross negligence or intent is fully liable for unauthorised use.
The user must notify the University of Eastern Finland without delay (by email at abuse@uef.fi or via the Service Portal at https://asiointi.uef.fi/) if they suspect that their username or password has come into the possession of an unauthorised party or if they detect unauthorised use of their credentials. After making such a notification, the user is not responsible for unauthorised use of the credentials occurring after the notification, provided that the user has prior to the notification acted with due care as described above.

6. Liability for Damages
The student is obliged to compensate the University of Eastern Finland for direct damages caused by the use of materials in breach of these terms of use, where such breach is attributable to the student's fault (intent or negligence).
The student is not liable for:
•    indirect damages, such as loss of income, loss of business, or other similar indirect losses of the University of Eastern Finland;
•    damages arising from circumstances that were not foreseeable or controllable by the student; nor
•    damages arising from unauthorised access to the student's credentials by third parties, where such access was not attributable to the student's fault.
Liability for damages arising under the Copyright Act (404/1961) is determined in accordance with section 57 of the Copyright Act.

7. Use of Materials Produced by Students
Materials produced by the student in the UEF Moodle learning environment (essays, seminar papers, learning diaries, group work materials, etc.) may constitute a work protected by copyright. Copyright in such materials belongs to the student. The University of Eastern Finland does not, under these terms of use, acquire ownership or any right of use of any scope in materials produced by the student.
The course teacher has the right to make materials relating to a student's course performance visible to other students on the same course, where this is necessary for conducting peer assessment or peer learning of the course performance. Such sharing takes place only within the closed UEF Moodle environment of the course, and the materials are not otherwise made available to the public.
Other students have the right to access materials made available to them in this way for the purpose of carrying out peer assessment or peer learning. Other students have no right to save, copy, distribute, or otherwise use materials relating to another student's course performance for their own purposes without the express consent of the author.
Materials are visible to other students only for the duration of the peer assessment or peer learning period designated for that purpose, unless the teacher indicates otherwise. Upon completion of the course, materials are removed from the view of other students.
When using or referring to another student's materials in connection with peer assessment or peer learning, other students must acknowledge the student's name in accordance with good practice.

8. Data Protection
The University of Eastern Finland processes the personal data of students and teachers (including first and last name) in the UEF Moodle learning environment for the purpose of organising teaching activities. The legal basis for processing is Article 6(1)(e) of the General Data Protection Regulation (EU 2016/679) (task carried out in the public interest or exercise of official authority), read together with the Universities Act (558/2009).
The student's name is visible within the course environment to students and the teacher on the course for the duration of the course, in order to enable the proper organisation of teaching and peer learning. This does not require the student's consent, as the processing falls within the scope of the University of Eastern Finland's statutory duties.
Further information on the processing of personal data is provided in the University of Eastern Finland's privacy notice, available at uef.fi/henkilotietojen-kasittely.

9. Warranty
By accepting these terms of use, the user of the UEF Moodle learning environment acknowledges that the University of Eastern Finland gives no warranty in respect of the UEF Moodle learning environment, the materials contained therein, or their fitness for any particular purpose, nor that the materials in the UEF Moodle learning environment do not infringe the rights of any third party. The University of Eastern Finland does not warrant that the UEF Moodle learning environment will operate without interruption or error.

10. Limitation of Liability
Regardless of the nature of the damages, the University of Eastern Finland is not liable for any direct or indirect damages arising from use of the UEF Moodle learning environment or from the UEF Moodle learning environment being wholly or partially unavailable. The University of Eastern Finland is not liable for materials uploaded to the UEF Moodle learning environment by users.

11. Governing Law and Dispute Resolution
These terms of use are governed by Finnish law.
Disputes arising under these terms of use shall primarily be resolved through negotiations between the parties. If a dispute cannot be settled between the parties within sixty (60) days of the commencement of negotiations, contractual disputes shall be resolved in the District Court of North Savo. However, the student also has the right to bring the matter before the district court of their domicile or place of habitual residence.
Disputes arising under the Copyright Act (404/1961) shall be heard by the Market Court in accordance with the mandatory provisions of that Act (Copyright Act, section 61).

12. Acceptance
I accept these terms of use by logging into the UEF Moodle system.
